Current Audio Magazine: A “Mixed Medium” Debuts with Presley Controversy
Current Audio Magazine promised a unique blend of written content and a vinyl record featuring interviews and commentary. The first (and only) issue, Vol. 1, No. 1, boasted an eclectic mix of figures like Mick Jagger, politicians, and controversial personalities like Charles Manson.
The magazine itself resembles a record sleeve, featuring a prominent musician on the cover (Jagger in this case). Inside, readers find written articles, photos, and an 8-page insert delving deeper into various topics.
However, the controversy lies with the inclusion of a 2.5-minute excerpt from Elvis Presley’s “First and only Press Conference” on the accompanying record. This, along with the use of Presley’s name and image throughout the magazine, sparked a legal dispute.
The core issue revolved around whether the magazine’s format infringes on Presley’s recording rights and publicity rights held by RCA. The legal battle would determine the fate of this innovative “mixed medium” and its use of copyrighted material.
While RCA held exclusive rights to recordings of his performances, a court ruled this didn’t extend to press conferences. They also deemed the event newsworthy, protecting the publisher from claims of publicity rights violation. RCA’s attempt to block publication failed, highlighting the court’s strong stance against their argument.
